Terms of Use

General

These Terms of Use shall be applied to the use of Illtags™ service ("Service") developed and hosted by Kaisla Innovations Oy ("Service Provider"). User undertakes to familiarize these Terms of Use prior registration and accept these Terms of Use upon registering to the Service. Service Provider grants the user the right to use the Service in accordance with these Terms of Use. The user acknowledges that the use of the Service is subject to user accepting these Terms of Use without modification. In case the user does not accept these terms, the user must immediately discontinue using the Service.

"Illtags" is an information service intended to provide data on the spread of infectious diseases . Said information is based on the information provided by the Users about real medical conditions. All spread patterns and other information provided are PREDICTIONS AND ESTIMATES ONLY and not necessarily bases on scientific analysis.

ILLTAGS IS NOT A SERVICE FOR PROVIDING MEDICAL ASSISTANCE, NOR DIAGNOSIS OF A PARTICULAR ILLNESS OR A PATIENT. NO INFORMATION PROVIDED IS INTENDED AS RECOMMENDATION FOR MEDICATION OR TREATMENT. AT NO TIMES SHOULD USERS RELY ON PROVIDED INFORMATION AS A SUBSTITUTE FOR SEEING A DOCTOR OR OTHERWISE SEEKING MEDICAL ATTENTION.

USERS WHO THINK THEY HAVE SYMPTOMS SIMILAR TO THOSE REPORTED IN THE SERVICE, OR WHO OTHERWISE THINK THEIR HEALTH MAY BE COMPROMISED, ARE ENCOURAGED TO SEEK MEDICAL ATTENTION. KAISLA INNOVATIONS EXPLICITLY DISCLAIMS ALL LIABILITY FOR DAMAGE CAUSED BY USERS NOT SEEKING PROPER MEDICAL ATTENTION OR ANY OTHER PERSONAL DECISIONS MADE BASED ON THE PROVIDED INFORMATION.

Registration

Registration is required for an individual to be able to contribute to the data base on which the provided aggregate information is based. Registration is currently available via FACEBOOK or TWITTER accounts. By registering via these accounts, the User gives the Service Provider the permission to import all relevant use date from said service.

BY REGISTERING TO THE SERVICE, THE USER GIVES PERMISSON TO THE SERVICE PROVIDER TO USE THE DATA PROVIDED, INCLUDE DATA ABOUT THE USERS HEALTH, MEDICAL CONDITION AND/OR SYMPTOMS, WHETHER GIVEN AT REGISTRATIOM OR LATER VIA ILLTAGS OR OTHER SOCIAL NETWORKING SITE (STATUS FEEDS). THIS PERMISSION INCLUDES THE RIGHT TO SEND TARGETTED PROMOTIONAL MATERIAL TO THE USER, IN EMAIL OR OTHERWISE.

User information

The Service Provider collects user Information at registration and when the User provides the Service Provider updates about their health. By accepting these Terms of Use, the User authorizes the Service Provider to handle User information collected in the Service according to the register description. The terms and principles of the register description and the privacy policy can be seen from here.

Any data entered into the Service by the User, save for any personal information such as contact details, becomes property of the Service Provider. User may request the deletion of their personal information at any time, i.e. unregister from the Service.

THE DATA IS SHOWN TO USERS IS ONLY ON AGGREGATE LEVEL WITHOUT LINK TO, OR IDENTIFICATION OF AN INDIVIDUAL USER. ALL DATA PROVIDED BY THE USERS MAY BE USED TO PROVIDE TARGETTED PROMOTIONS AND OTHER RELEVANT INFORMATION TO THE USER. AT NO TIME WILL ANY DATA PROVIDED BY THE SERVICE PROVIDER TO THIRD PARTIES WITHOUT THE USERS EXPLICIT CONSENT, EXCEPT IN AGGREGATED FORMAT WHERE NO INDIVODUAL USER CAN BE INDENTIFIED, OR IF REQUIRED BY LAW OR OFFICIAL ORDENANCE.

Availability of the Service

The Service Provider aims to provide the Service without service breaks. The Service is, however, provided for now and the Service Provider can denounce and discontinue to provide the Service or a part of the Service any time. The Service Provider is not responsible of any consequences caused for the user by any Service breakdowns or by a sudden closure of the Service.

SERVICE PROVIDER SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF THE SERVIVE PROVIDER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES) ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF THE SERVICE OR THE SOFTWARE, DOCUMENTS, PROVISION OF OR FAILURE TO PROVIDE SERVICES, MALFUNCTIONS, TECHNICAL FAILURE, HARMFUL PROGRAMS, LINKS, BREAKDOWNS OR INFORMATION AVAILABLE FROM THE SERVICE.

Rights and responsibilities of the User

The use of the Service requires a username, password and registration to the Service. The password of each User is personal. The User has the responsibility to store the username and password carefully in order to avoid others to know the username and the password. The User must inform the Service Provider immediately if he/she suspects that his/her password is known by a third party without his consent. The User is always responsible of all the use of the Service done by his username and password. The user is responsible for the material delivered to the Service Provider, other users or third parties. The user is particularly responsible for ensuring that the material delivered does not infringe copyrights or other intellectual property rights.

The user shall use the Service pursuant to these Terms of Use, good practice, and the applicable law of the country, where the user uses the Service. The Service may not be used in an area of which laws and/or regulations forbid the use of the Service. The Service may not be used in a way, which is harmful or otherwise offensive for the Service Provider, other users of the Service or third parties. Pornographic, immoral, criminal or misleading material may not be sent to the Service.

The material referred here are all the files and data stored in the Service. This consists of picture and other files as well as all the texts sent into the Service by Users.

The Service is protected by copyright in accordance with the laws of Finland. Moreover, the Service may contain material protected by trademark rights or other intellectual property rights. In addition to what is stated in these Terms of Use, the user has no right, without the express consent of the Service Provider or other right holder and only when the legislation especially permits it, to distribute, publish, copy, modify, communicate or make available to the public or otherwise commercially exploit, entirely or partly, the Service or any of the material contained therein. The User may not utilize the Service or parts of the Service in other ways without a written consent of the Service Provider. The use of the Service for commercial or for business uses or for information service purposes is forbidden.

The user has no right to link the materials in the Service directly to other services.

You will not collect other users' information, information posted be the Service Provider, or otherwise access Illtags, using automated means (such as harvesting bots, robots, spiders, or scrapers) without our permission.

You will not upload viruses or other malicious code.

Rights and responsibilities of the Service Provider

The Service Provider has the right to change the Service, its features, its purpose, its availability and the requirements for the equipment needed to use the Service, anytime. Service Provider has the right to cancel User's username, password to the Service in its sole discretion. The Service Provider has the right to not respond to the inquiries concerning the Service and the right to not provide support services for the Service.

Service Provider shall use its reasonable efforts to ensure that the Service can be used without interruptions. However, in case the Service has breakdowns due to upgrading or maintenance work or due to non-operability of communication facilities or some other reason, the Service Provider shall not be responsible for any such breakdowns, for any delays in the information delivery, for changes in the information nor for losses of the information. The Service Provider is not responsible for any direct or indirect damages caused by changes in the Service, by cancellation of the Service or for damages caused by the content of the Service. The Service Provider is not liable for the User's or for third parties for any content or functionality of the Service.

The material sent to the Service is done by the User and he/she is fully responsible of the content of the material. The Service Provider is not responsible in any way of the material, of the authenticity of the material, whether the User has the right to distribute the material nor for other issues related to the material. The same applies to all the other information and information files sent to the Service or shared in the Service. The Service Provider is not responsible of the information received by the User via the Service, any copyright issues related to the information nor of the content that may breach law or good manners. The Service Provider is in not in any way responsible for the content of the messages and the texts written by Users.

Service Provider will not necessarily control the contents of the Service in any manner. The Service Provider has, however, the right to remove any content (e.g. pictures and other files and the texts written by Users) that it sees inappropriate or harmful and/or false, without hearing the User or without informing the User beforehand. The Service Provider has the right to hand over illegal material or material that is against the Terms of Use to legal authorities. The Service Provider has the right to remove a User from the Service that has given false user information or who has in some other way violated these Terms of Use, law or good manners and the right to inhibit the User to use the service without hearing the User. The Service Provider has also the right to require the User to change his/her password, if the Service Provider suspects that the password is no more reliable or in the right hands.

Other services provided by the Service Provider

The Service Provider may provide the possibility to purchase or use other services and products of the Service Provider in the Service. These Terms of Use shall be applied into such other services and products provided by the Service Provider if other is not signaled in relation to these services and products.

The Service Provider is not responsible of the services provided by its partners.

The Service Provider provides the possibility to purchase or use the services and products of third parties ("Partners") via the Internet pages of the Service or via the Internet pages of the Partners.

The User agrees that the Service Provider does not have any liability over the purchase or use, any payment issues or any issues related to deliveries of the products and services of the Partners. The Service Provider is neither responsible in any way over information presented in the Internet pages of the Partners independent of the fact whether the pages are technically in the Service Provider's server or in some other server.

Changing of the Terms of Use

Service Provider has the right, in its sole discretion, to update, revise, supplement, modify or amend these Terms of Use at any time by notifying the users via the Service, via email or via written document. All changes made to the Terms of Use shall be immediately effective. Effective Terms of Use are always available on Service's www- site, www.Illtags.com. In case a user is willing to continue using the Service after the changes have been made, the user shall be deemed to have accepted the changed terms.

After receiving information of the changes, the user may terminate the Service by sending a message to the Service Provider either by using the feedback form on www.Illtags.com or by email to info@Illtags.com.

Service Provider has a right at any time to transfer the users and their rights of use to the subsidiaries or affiliated companies of the Service Provider or to the third party as a result of the merger or acquisition or any other business transaction. The user has no right to transfer the user rights. The user particularly acknowledges that the right to use the Service, granted by the Service Provider, is personal and it cannot be given to any third party.

Territorial restrictions

The use of the Service is always permitted from the member states of the European Union and from the Nordic countries. The use of the Service from other countries may be restricted by the Service Provider.

Insurmountable obstacle

A strike, a lockout, a fire, a network error, an order by an authority or other insurmountable obstacle (force majeure) independent of the Service Provider releases the Service Provider from following these Terms of Use during the insurmountable obstacle.

Governing law and dispute resolution

This agreement is governed by, and shall be construed in accordance with the laws of Finland excluding its choice of law rules. All disputes relating to the Service, the use of the Service and these Terms of Use shall be primarily settled amicably between the parties. In case amicable settlement of the dispute is not possible, Helsinki District Court shall have the sole jurisdiction.

Miscellaneous

The invalidity of a provision of these User Terms or any other applicable terms and notices shall not affect the validity of the remaining provisions. The invalid provision shall be replaced with a valid provision, which comes closest to the result and purpose of these User Terms or any other applicable terms and notices. These User Terms shall neither exclude nor limit any of your mandatory rights in your country of residence.

Breach of these Terms

Any user breaching these terms may be removed from the Service by the Service Provider at its sole discretion. Removal from the service shall not limit Service Providers right to seek other remedies.
